1. Introduction

Welcome to Marisa Demos Photography (“Website,” "Company," “we,” “us,” “our”, ). By engaging our photography services, you agree to the following Terms and Conditions. Please read them carefully.

  • Ownership: All content on this Website, including but not limited to text, images, graphics, logos, and videos, is the property of Marisa Demos Photography or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

2. Services

We offer a variety of photography services including, but not limited to, wedding and elopement photography, engagement photography, and maternity and lifestyle photography. Detailed descriptions of our services can be found on our Website or obtained by contacting us directly.

3. Booking and Payment

  • Booking: To secure a booking, you must complete our online booking form and agree to the terms of our photography contract. A non-refundable retainer along with a signed contract are both required to solidify date. Retainers vary per session. This retainer will be applied to the total cost of the service. Availability is not guaranteed until a confirmation is provided.

  • Payment: The remaining balance is due on or before the day of the session or event unless otherwise agreed upon in writing. We accept payment via credit or debit card, Venmo, or Chase Zelle.

  • Additional Charges: Any additional services or products requested outside the scope of the original agreement will incur extra charges, which will be agreed upon prior to provision of those services.

4. Cancellation and Rescheduling

  • Client Cancellation: Should you need to cancel your booking, please provide at least 60 days' notice for weddings and elopements, and at least 48 hours for any other session provided. The retainer is non-refundable. If cancellation occurs within 60 days of the scheduled service for weddings and elopements or 48 hours of any other session, you will be liable for the full amount of the service.

  • Rescheduling: We will do our best to accommodate rescheduling requests. A new retainer will apply if changes are made more than 365 days from the original wedding/elopement date. A enw retainer is required to book a session if the rescheduled date is more than 3 months from the original date.

  • Refunds, if applicable, will be processed according to the terms specified in the Cancellation Policy.

5. Client Responsibilities

  • Preparation: Please ensure that you arrive at the location at the agreed time. If you are late, the session will be shortened accordingly and there will not be a proration of the price.

  • Location: If the location is not specified in the booking, it is your responsibility to provide accurate details and obtain necessary permissions for us to shoot at the chosen location.

  • Conduct: You agree to follow our reasonable instructions and cooperate to ensure a successful session. Unreasonable behavior may result in the termination of services without refund.

6. Intellectual Property and Usage

  • Copyright: All images taken by us are copyrighted and remain the property of Marisa Demos Photography. We grant you a non-exclusive, non-transferable license to use the images for personal or commercial purposes as specified in the service agreement.

  • Usage Rights: Any additional usage rights or extended licenses must be negotiated and will incur extra fees. You agree to credit Marisa Demos Photography in any publication or social media post where the images are used. Re-editing and filtering the images delivered by Marisa Demos Photography in your final gallery are prohibited. 

  • Limited License: You may view, download, and print content from this Website for your personal, non-commercial use only. Any other use, including the reproduction, distribution, or modification of content, requires prior written permission from Marisa Demos.

7. Image Delivery

  • Format: Images will be delivered digitally via Pic-Time as agreed upon.

  • Delivery Time: The standard delivery time for images varies based on the complexity of the packages. For more information on delivery time of images, please refer to the details of each specific package that is offered located in designated tabs on the Website.

8. Limitation of Liability

  • Liability: Our liability for any claim related to our services is limited to the total amount paid by you for the specific service. 

  • To the fullest extent permitted by law, Marisa Demos and Marisa Demos Photography shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or our services.

9. Privacy and Data Protection

  • Personal Data: We will collect, store, and process your personal data in accordance with applicable data protection laws.

  • User Submissions: Any feedback, comments, or suggestions you provide to us through this website or through submitted inquiries will be considered non-confidential and non-proprietary. By submitting such materials, you grant Marisa Demos Photography a worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, and distribute them.

  • External Websites: This Website may contain links to third-party websites that are not owned or controlled by Marisa Demos Photography. We are not responsible for the content or practices of any third-party websites. Your use of third-party websites is at your own risk.

  • Prohibited Activities: You agree not to use this website for any unlawful purpose or in any way that could damage, disable, overburden, or impair this Website. You shall not attempt to gain unauthorized access to any part of this Website or any systems or networks connected to this Website.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Michigan, United States. Any disputes arising from these terms will be resolved in the competent courts of Michigan, United States.

We reserve the right to update or amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our Website. Continued use of our services after any such changes constitutes your acceptance of the new terms.
